Question

To the Rav, shlita: I wrote a condensed article to clarify that in our generation there is an obligation to put tekhelet in tzitzit, and I’d be happy if the Rav would look it over and share his enlightening comments (because I added a bit on my own).

B”H — regarding the obligation to put tekhelet nowadays

Nowadays the chilazon of argamon keheh kotzim (called in other languages “porpora” and “murex”) has been identified as the chilazon of tekhelet that the Torah speaks about, and there is an obligation to put it in tzitzit (this is how three of the great poskim of our generation ruled: Rav Dov Lior, Rav Zalman Nechemia Goldberg, and Rav Meir Mazuz, and others). We will explain the proofs one by one:

  1. It says in the Gemara (Menachot 44a): “This chilazon—its body resembles the sea, its form resembles a fish, it comes up once in seventy years, and with its blood they dye tekhelet.” Regarding the identification as the chilazon: it is proven from Midrash Rabbah (Shir HaShirim Rabbah 4:11, and other sources) that “a chilazon—so long as it grows, its nartik (shell/casing) grows with it,” and the argamon’s shell grows with it as well.
  2. Regarding “its body resembles the sea”: this fits argamon, which has a biological attachment that gives its body a sea-like appearance. (One of the ancient researchers described the argamon as a “stormy sea” because of this attachment. And I, the humble one, thought of an additional possibility: because of the protrusions on its body it looks like sea waves; and I think Rav Tavger wrote similarly.)
  3. Regarding “its form resembles a fish” (as Rashi explains the word “briyato,” and like Rabbeinu Chananel there, that it refers to the shape of the substance itself): this fits argamon, whose outline is like a kind of “diamond” shape, similar to a fish (so wrote Rav Shmuel Ariel and others).
  4. And of course, from the argamon one produces a tekhelet dye that resembles the sea, as described in the Gemara in Menachot and Sotah about the tekhelet of tzitzit—so there is no reason to claim that maybe it isn’t the tekhelet the Torah spoke about.
  5. Another proof to the authenticity of the tekhelet color produced from argamon: it resembles the color that comes from kela ilan (called “indigo” in other languages, as the Rishonim write). The Gemara (Menachot 42b; Bava Metzia 61b) says its color is like the color that comes from the chilazon of tekhelet, except it is not kosher—because tekhelet is kosher only from the chilazon, as it says in the Tosefta Menachot 9:6 (so wrote Rav Borstein and others).
  6. The Gemara (Shabbat 75a) says that extracting the dye as quickly as possible from the time of capture improves the quality of the dye (“the more life it has in it, the better for him”), and Rashi explains: “he troubles to keep it alive so it won’t die in his hand.” Meaning: the faster they extract it after capture, the better for dye. This is also written by ancient researchers, and it applies to argamon (see Rav Borstein’s sefer).
  7. Another sign: the Pesikta Zutarta (Devarim 33:18; also Midrash Lekach Tov there) says “sefunei temunei chol” refers to the chilazon of tekhelet that hides itself in sand (and there are other sources that it burrows into the seabed—see Raavad on Sefer Yetzirah and Ramak mi-Pano). This is also implied by Rashi in Menachot 44a on “oleh,” where he writes “from the ground,” and the Noda BiYehuda explains: elsewhere (Bava Metzia 61b on “kela ilan,” and more) Rashi says it is found in the sea, so “from the ground” must mean it rises from the seabed. And this is why the baraita says “resembles a fish”—because it is not literally a fish: it grows on the seabed, not in the water column itself. According to the Noda BiYehuda, this also clarifies the Rambam (Hilchot Tzitzit 2:2) who calls the chilazon a “fish”—meaning it is in the water, though not literally a fish. (Some explain differently, based on the Gra in Keilim 11:1 that “everything in the sea is a type of fish,” and therefore Rambam called it “fish,” though not like our fish. But the author argues this is difficult in light of R’ Herzog’s question, and he prefers the first explanation.) In practice, argamon keheh kotzim does burrow into the seabed and later comes up and floats and is washed to shore (so wrote Rav Borstein).
  8. The Gemara (Shabbat 26a; see also Megillah 6a) says the chilazon of tekhelet is found on the Mediterranean coast between Sulama de-Tzor and Haifa—and that fits argamon.
  9. The Gemara (Menachot 42b–43a) describes how they test tekhelet strings to see if they are authentic from the chilazon or a fake: whether they degrade from certain chemicals (Rishonim argue which chemicals), but either way we see that one sign of real tekhelet is that it is durable and strong. Argamon keheh kotzim is known for strong durability.
  10. The Gemara (Shabbat 133b and elsewhere) says the “blood” used for dyeing tekhelet is mifkad pakid, and Rashi explains: “stored and set aside there, as if placed in a vessel.” That fits argamon: the dye-fluid for coloring is mifkad pakid—it is not absorbed into its body like ordinary blood; it comes out readily.
  11. The Gemara (Shabbat 75a) says “ha-potze’a,” and R’ Herzog inferred this implies something hard that requires “cracking.” That fits argamon, where one needs to crush the shell to extract the dye.
  12. The Ran (Chiddushim to Shabbat, beginning of Perek Shemonah Sheratzim) writes about the chilazon of tekhelet that it “is not a creature with limbs.” That fits argamon.
  13. There are additional scientific and archaeological proofs that argamon is the chilazon of tekhelet (brought by Rav Borstein), but since they do not affect halakha directly and are only chazi l’itztarufe, they are not detailed here.

Questions raised against identifying argamon keheh kotzim as biblical tekhelet, and answers

  • Rabbi Isaac Halevi Herzog asked: the dye from argamon isn’t tekhelet—its main color is purple.
Answer: In Rav Herzog’s time they did not yet know that exposing the dye to sunlight at the start produces tekhelet. And it is simple that today Rav Herzog would prefer argamon keheh kotzim over the “jentina” he leaned toward.
  • Rav Asher Weiss asked: if sunlight exposure is needed, why doesn’t the Gemara mention it?
Answer: Because the dye preparation was done outside in daylight anyway, as described by ancient sources and archaeologists (and also because of the need to extract quickly from capture—see Shabbat 75a—so it was done right at the shore; and archaeologists say the dyeing installation was outdoors). Also, from the Radziner Rebbe it is clear you can’t claim Chazal had to record the entire production process.
  • Rav Asher Weiss also asked: the dye isn’t extracted from “blood” itself but from a specific sac.
Answer: Precisely the opposite: the Gemara says mifkad pakid (Shabbat 133b)—stored separately, not absorbed like ordinary blood.
  • Another question: Rambam (Hilchot Tzitzit 2:2) says the color of the “blood” is black, but the fluid from argamon is initially clear.
Answer: The sediment that is obtained at first is black (Rav Borstein writes this בשם a qualified chemist). Another answer: the meaning is that while it is still inside the sac it is black—and that is true of argamon as well (see also Rav Shmuel Ariel’s article).
  • Another question: according to Rashi, the dye is “yarok” (green), which doesn’t fit argamon.
Answer: The Gemara already says it is like the sea and like kela ilan; those certainly are not pure green. Rather, Rashi means there is a greenish tint within tekhelet, as seen in sea-color and in kela ilan, and that is also seen in argamon tekhelet (see the photo in Rav Borstein).
  • Another question: Rashi (Sanhedrin 91a and elsewhere) calls the chilazon a “worm,” and argamon is not a worm.
Answer: Chazal say it has a nartik that grows with it, as above; it is not like “worms” we speak about today. Rashi’s intent is that it is “without limbs” like a worm, but not literally a modern worm (see Rav Borstein).
  • Another question: Menachot 44a says it “comes up once in seventy years,” and argamon is not like that.
Answer: The Gemara spoke in an exaggerated way, as several Acharonim write; and in the Tosefta there is a different girsa “once in seven years,” implying it’s a manner of speech describing rarity and difficulty of obtaining. And this argamon is also hard to obtain in a useful quantity for tzitzit, except in two short periods per year (as Rav Borstein writes). Others give different answers (see R’ Sender in “Eliav ve-Achisamach,” that it refers to the age of the chilazon; and see Ridbaz).
  • Another question: Rambam writes it is found in the Yam HaMelach (Dead Sea), and argamon is not found there.
Answer: There are no living creatures in the Dead Sea, so clearly—like Rav Kapach and others proved—when Rambam writes in Arabic “the salty sea,” he means the Mediterranean.
  • Regarding the Besamim Rosh, who required “seventy mesorot” to obligate tekhelet (without bringing proofs): Acharonim already rejected him; see Shu”t Divrei Menachem 1:3 and more. And even if he were right, we rule safek de-oraita le-chumra, as will be explained.

Even if you say it’s not certain: safek de-oraita le-chumra

In any case, even if a person holds that the biblical tekhelet was not identified with certainty, there is still an obligation to put tekhelet because of safek de-oraita le-chumra.

And you can’t push this away based on the view of a certain Gaon (brought by the Radziner Rebbe, and common today as a reason not to put tekhelet) that this chumra doesn’t apply if we are still stuck in uncertainty and the signs don’t indicate this is tekhelet (in their view). First, later Acharonim rejected that reasoning (the Radziner himself, and also Divrei Menachem—who holds there is no definitive identification—also rejected it; and that Gaon did not bring proof, and Acharonim brought contradictions).

But even if you accept that sevara, it doesn’t apply nowadays: the level of identification rose dramatically with the discovery of argamon keheh kotzim and knowledge of how to process it, and today for many גדולים (great poskim across three communities, and many major talmidei chachamim, and most researchers who seriously studied tekhelet) it is considered a certain identification.

And even Rav Yosef Shalom Elyashiv (Kovetz Teshuvot 1:2) raised this point: maybe the new identification that researchers claim is very clear actually is a certain identification, and then Beit HaLevi’s challenge wouldn’t apply. Rather, he adds there that since many identifications were rejected in the past, who says this one won’t be rejected, and therefore there is no obligation to investigate the new identification.

But Rav Natan Rotman wrote (in the “P’til Tekhelet” booklet, 5777), and he heard from Rav Elyashiv’s students, that Rav Elyashiv’s words were only about the obligation to investigate, but he did not reject the identification; and if someone investigates and concludes it is a certain identification, it is obvious that he must put tekhelet.

He also brings a report from Or Yisrael (5758, p. 139, quoting a responsum of the Rishon LeTzion Rav Yitzchak Yosef) that near the end of Rav Elyashiv’s life, when tekhelet was discussed, he said that only because of financial burden on the charedi public did he not put tekhelet—implying he did not investigate deeply due to practical burden, not because he rejected it in principle.

Therefore, since Rav Elyashiv did not reject the identification, only the obligation to investigate: if his students learn the sugya and recognize the truth of argamon identification, they would be obligated to put tekhelet. And furthermore, even if they want to follow poskim who say it’s not certain, they would still have to be stringent because of safek de-oraita—since they themselves recognized the identification, the “Gaon’s” sevara above wouldn’t apply.

Likewise, one cannot dismiss this based on Divrei Menachem 1:3 (mentioned above) that there is no obligation to be stringent from safek—because that כלל was said only regarding גדולי הדור whose rulings the ציבור accepts broadly in other areas; they would need to accept the stringent opinion of such recognized גדולים, but not of a “gaon” (as great as he may be) whom the public does not generally follow in other matters (like the Radziner Rebbe). But today this too doesn’t apply for many people, because three major poskim whose rulings are broadly accepted—like Rav Meir Mazuz, Rav Dov Lior, and Rav Z.N. Goldberg—hold the identification is certain; therefore even if such a person personally doubts it, he should be stringent like those poskim and put tekhelet, as a safek de-oraita.

Summary:

  • Those who follow the rulings of Rav Dov Lior, Rav Z.N. Goldberg, Rav Meir Mazuz, and others, have an obligation to put tekhelet as a certainty, based on the identification explained above.
  • Even those who follow Rav Elyashiv’s position that there is no obligation to investigate—if they investigated and found the identification true, they would be obligated to put tekhelet; and even if they’d want to claim it’s not certain, they would still have to be stringent because of safek de-oraita.
  • Even those who follow Divrei Menachem would need to be stringent in putting tekhelet like the broadly-accepted poskim mentioned, if they generally accept their rulings in other areas. Additionally, they have an obligation to investigate the renewed argamon identification, which Divrei Menachem did not fully know in detail.

Answer (Rav Shmuel Ariel)

Shalom u-vrakha!

Yeyasher kochacha for the overview. As you requested, I’ll make two comments:

A) Rambam’s wording: “and it is a fish”

Regarding Rambam’s wording “ve-hu dag” (“and it is a fish”): see Rambam’s Perush HaMishnayot to Keilim 12:1, where Rambam explicitly writes that the chilazon is a sea creature that has a shell (tzedaf / konchiyah). If so, it is obvious that what Rambam wrote in Hilchot Tzitzit “and it is a fish” does not mean a literal fish, but rather—as you mentioned—because it lives in the water.

B) Rashi calling tekhelet “yarok”

Regarding the question from Rashi’s wording, that he wrote tekhelet is the color “yarok”:

You should know that in the language of Chazal and the Rishonim, there was no separate name for the shade we call “kachol” (blue). Rather, it was included in the word “yarok.” The word “yarok” included shades that we call green, blue, and yellow.

You can see this in a number of places. For example, in Bereshit Rabbah 4:7 they list the different colors of the sky, and there is no word that means “blue.” The first shade listed is “yarok”—meaning that the usual color of the sky, what we call blue, was called “yarok” by them.

And this is explicit in the Rema’s gloss to Shulchan Aruch Yoreh De’ah 188:1, that the shade we call “blue” is included in “yarok.” And in the language of Chazal and the Rishonim there isn’t a word that describes “blue”—see there in the Rema, that in order to indicate the shade “blue” he had to use the foreign word “blau,” because in the Hebrew of his time (and likewise in other ancient languages) there wasn’t a specific word for that shade.

(In Rambam Hilchot Tzitzit 2:1, the printed editions have the word “kachol,” but in the manuscripts the girsa is “koachol,” meaning a substance used for the eyes, not the name of a shade. And indeed, Rambam describes tekhelet by comparing it to the color of the sky, because he has no single Hebrew word to pin down that shade precisely.)

So there is no difficulty in Rashi writing that tekhelet is “yarok,” because that is the word used in his time for the blue shade. And see also Rashi in Chullin 89a, s.v. “she-ha-tekhelet,” where Rashi explicitly writes that the blood of the chilazon resembles the sea—meaning blue.
