וכמה תהא משולשת? ב”ש אומרים: ד’, וב”ה אומרים: ג’;

Principles in the rules of the Gemara and in its language

Does Archaeology Contradict Halacha?
[Tannaim and Amoraim; Halachic Principles; Key Terms] Bava Basra 74a

Rabba bar bar Chanah said to someone: “Come, I’ll show you the corpses of the Dor HaMidbar.” We went, I saw them, and they looked like people who were bloated.
They were lying on their backs, and the knee of one of them was sticking up. A certain Arab came riding a camel and passed under his knee with a spear raised—and didn’t even touch him.
I cut off one corner of the tzitzis of one of them, and then we couldn’t move from our place. He asked me, “Maybe you took something from them?” I returned it, since we have a tradition: whoever takes something from them can’t leave until he puts it back.
After I returned it, we were able to move again.
When I came to the Chachamim, they said to me: “Every story of your father is wine, but every story of bar bar Chanah is cheap vinegar! What’s the point of what you did?”
They told him: “If you wanted to know whether the halacha is like Beis Shammai or Beis Hillel, you should’ve counted the strings and the windings (chulyos)!”

1. From the Gemara, it’s mashma that according to the Rabbanan (i.e., the Rebbeim of Rabba bar bar Chanah), it would’ve been possible to clarify how the Dor HaMidbar tied their tzitzis—how many strings they had on each corner.
The point was to determine the halacha—whether like Beis Shammai or Beis Hillel.

2. Tzitzis Sugya: Menachos 41b:
The Tannaim argued:

How many strings does one place?
Beis Shammai: 4,
Beis Hillel: 3.

And how many chulyos (windings)?
Same machlokes:
Beis Shammai: 4,
Beis Hillel: 3.

The 3 of Beis Hillel is defined as: 1/3 of the total length of the strings (about a tefach).
Rav Pappa says: a tefach depends—4 finger-widths for a regular man, 6 for a small hand, 5 for average.
Rav Huna says: 4 strings, 4 windings.
Rav Yehuda says: 3 strings, 3 windings.
Rav Pappa concludes: Halacha is: 4 strings with 3 windings, each winding made of 4 loops.

So we see Rav Pappa paskens like Beis Shammai.

3. Rambam (Hilchos Tzitzis 1:6) rules:
You start from the corner, not more than 3 fingerbreadths away from the edge, and not less than the width of a thumb.
You insert 4 strings and fold them in half—makes 8 hanging down.
They should be tripled (chulyos), each 4 fingerbreadths long…

4. There are 6 places in all of Shas where we pasken like Beis Shammai instead of Beis Hillel.
Tosfos (Sukkah 3a):
Quotes from the Siddur of Rav Amram Gaon—6 cases we go like Beis Shammai:

  • Sukkah must hold head, majority of body, and table
  • Tzitzis: Beis Shammai says you’re patur with a linen garment, Beis Hillel says chayav
  • Number of strings: B”Sh – 4, B”H – 3
  • Number of chulyos: B”Sh – 4, B”H – 3

In all these cases, we pasken like B”Sh.

5. From this story in the Gemara, it seems that min haShamayim they didn’t want Rabba bar bar Chanah to determine the halacha based on what he saw by the Dor HaMidbar.
Even when he tried to bring back an actual corner of their garment—they didn’t let him. Something stopped him.

6. See the Schottenstein on Bava Basra 74a note 9:
Quoting Rav Chaim Kanievsky in Taama D’Kra (p. 130):
He says that from the fact that they didn’t let him take the corner or even think to count the strings, it’s clear that Hashem doesn’t want halacha to be determined by digging through ancient evidence.
Halacha must be established only through Torah itself—not through archaeology.

Meaning: Halacha is set by Chachmei HaTorah—not historical evidence.
So we shouldn’t pasken based on archaeological finds (e.g., for mikveh size, etc.).

7. However—with all due respect—one could ask:

That idea only makes sense after the halacha was already established.
In our sugya, they were trying to clarify what the halacha should be—maybe not to change it, but to verify if it was a mistake to pasken like Beis Shammai, since usually halacha follows Beis Hillel!
(Remember, even that general rule came through a bas kol—Heavenly voice.)

7.1 And it’s hard to say it was all pointless—since from that very story, some Chachamim learned that we bury the dead in a tallis!
See Tosfos “Paskai” and Schottenstein note 3.

7.2 Also, we find many cases in Shas where they clarified halacha by checking what was done historically—especially regarding the Beis HaMikdash.

7.3 And later in our sugya (Bava Basra 74b), there’s the story of the 18th:

A bas kol came out and said: “What do you have to do with the basket of the wife of R’ Chanina ben Dosa? In the future, she’ll sew techeiles onto it for the tzaddikim in Olam HaBa.”

The Rosh (Gittin, Perek 4 siman 46) brings proof from here that women can make tzitzis!
See also Schottenstein note at end of note 1.

8. So from all of this, we see like we said in #7:
You’re allowed to use historical facts, stories, even dreams—to help pasken when the issue wasn’t decided clearly in Shas.
But once it was decided in the Gemara—you can’t overturn it with archaeological evidence.

8.1 And maybe that applies even to halachos that were set later, after the Gemara—i.e., you can’t go against the accepted psak of Rishonim/Acharonim using archaeology.

8.2 Compare this to the Chazon Ish’s opposition to using newly found manuscripts—even for learning, let alone psak!

Chazon Ish (O.C. 67:3:12), on Eiruvin 9b:
“I don’t know if we can rely on newly printed editions, since we don’t know who the copyists were. Even careful copyists make lots of mistakes. And if anything’s off, it can change the whole meaning.
The mesorah between us and the earlier poskim wasn’t broken. They worked hard to preserve and clean the texts.
So their sefarim are more reliable.
Especially when it’s about grammar or exact wording—we can’t rely on these new editions.”

So is it just about technical issues—accuracy of the copying?
It seems the Chazon Ish is also emphasizing mesorah and the exactness of traditional texts.

9. Even if Chazal would’ve known the historical facts, they had the authority to pasken differently.
That’s the koach of Torah Sheba’al Peh.
The only question is: how far does that koach go? Does it extend to poskim of our generation too?
