Bottom Line

These two letters continue the pushback against R’ Eliyahu Tavger’s defense of the Murex identification. R’ Shimon Kabasa largely comes to R’ Aharon ben Yaakov’s defense, arguing that several of Tavger’s readings run against Rashi and that his objections do not really answer the original problems raised from the simanim of Chazal. In particular, he defends reading “its body resembles the sea” as referring to color, challenges Tavger’s reading of damav, and rejects the claim that Ben Yaakov gave the Radzyner cuttlefish an easier standard than the Murex.

R’ Aharon ben Yaakov then responds himself. He does openly concede one technical point to Tavger — that extracting the dye can involve both breaking the shell and then squeezing out the secretion — but insists that this does not rescue the Murex identification. His basic position remains that if the Murex fails even one legitimate description of the chilazon found in Chazal or the Rishonim, its identification remains doubtful. He also presses the Rambam’s description of the chilazon as a “fish,” criticizes Tavger’s handling of the term petziah, and argues that Tavger selectively quoted Rav Herzog while overlooking Herzog’s later warning about scientific experts making confident claims without sufficient experimental basis.

The overall tone is not a new positive identification of another creature, but a defense of the “the Murex has not met the burden of proof” position. The most significant feature is that Ben Yaakov is willing to retract a specific argument when shown to be mistaken, while maintaining that his broader objections to identifying the Murex with the chilazon still stand.

א. מ”ש באות ד שהרה”כ יוצא מתוך נקודת הנחה שהברייתא מדמה החלזון לים בצבעו, אך דבר זה אינו מוזכר שם כלל;

Regarding Tekhelet

To the honorable editorial board of the distinguished Ohr Yisrael journal,

I saw what Rabbi Eliyahu Tavger wrote (in issue 76), responding to Rabbi Aharon ben Yaakov’s article (issue 75) regarding Tekhelet, and I would like to make several comments.

A. Regarding what he wrote in section 4, that the author is working from an assumption that the baraisa compares the chilazon to the sea in its color, whereas this is not stated there at all:

This “assumption” is in fact stated by Rashi: “gufo — the appearance of its body.” And as is well known, the word mareh in the language of Chazal means color, as in the four mar’os of nega’im — meaning the four shades of nega’im.

B. He also writes in section 5 that some explain briyaso to mean the manner in which it reproduces, namely that it lays eggs (Y. Felix). It is surprising to bring the words of some researcher against the explanation of Rashi quoted by Rabbi ben Yaakov: “briyaso — the form of its appearance.” This is also how it appears in the Shitah Mekubetzes.

C. He also writes in section 7 that according to our text, when it says “therefore its damim are expensive,” the meaning is that its blood is used to dye Tekhelet.

This is against Rashi, who explains: “Therefore, since it only comes up once in seventy years, its damim — its price — is expensive.” Perhaps this is what Rabbi ben Yaakov meant when he wrote that they first shoot the arrow and only afterward draw the circle around it — that they are writing against Rashi.

D. Regarding what he writes in section 13, that “there is no way to know which color of the me’il Tosafos was referring to,” since the hem of the me’il also contained argaman and tola’as shani:

This is very forced. The Gemara is discussing blood that splashed onto the me’il. It is extremely difficult to say that Tosafos set up the case specifically where the blood splashed onto the bells rather than onto the body of the me’il itself, concerning which the Torah says (Shemos 28:31), “kelil Tekhelet” — entirely Tekhelet.

E. Regarding what he writes in section 20, that the author is lenient toward the cuttlefish, and that the simanim which are suddenly demanded of the Murex are somehow not demanded of the cuttlefish:

I do not know where he found this in Rabbi ben Yaakov’s words. He explicitly wrote: “Both are disproven by the same argument, namely that they do not fit all the simanim of Chazal. What advantage does one have over the other?” This requires explanation.

Further Regarding the Above

I saw what Rabbi Eliyahu Tavger wrote (in issue 76) in response to my article in the previous issue. I do not intend here to answer all of his points, but since something new occurred to me, I cannot leave the matter entirely without comment.

A. Regarding what he wrote in section 5, defending his position that there is no particular shape that defines a fish:

The Rambam writes (Hilchos Ma’achalos Assuros 2:12):

“What is a sheretz hamayim?… The general rule is that anything which does not have the form of a fish — neither a non-kosher fish nor a kosher fish — such as a kelev hamayim, a dolphin, a frog, and the like…”

Certainly, according to the Rambam, this chilazon is not in the form of a fish. One who eats it therefore violates the prohibition of eating a sheretz hamayim, rather than the prohibition of eating a non-kosher fish. And it was the Rambam himself who wrote about the chilazon, “and it is a fish.”

[Admittedly, in Sefer HaMitzvos, negative commandment 179, the Rambam writes that it is possible for something to be both a fish and a sheretz hamayim. Nevertheless, the proof still stands. Understand this carefully.]

B. In section 9 he writes that there are two stages involved with the chilazon: first, breaking the shell, and second, squeezing out its blood by hand.

On this point the author is correct, and yasher koach to him for setting me straight regarding this detail. Nevertheless, I already wrote in my article that even if I am correct on only one point, that alone proves that this is not the chilazon of Chazal. By contrast, those who identify the Murex as the chilazon need to be correct in all of their claims.

However, his words are difficult to understand. On the one hand, he explains that petzias hachilazon refers to squeezing its soft body by hand. On the other hand, he brings a proof from the term petziah that it refers to the hard shell. I do not understand how he can hold both ends of the stick. Incidentally, the term petziah is also used regarding a person and similar cases, as in Shulchan Aruch 204.

[Incidentally, I would also note that he writes that throughout my article I fell into a logical error because I want the Murex to fit two contradictory opinions. I do not know where he got this from. It has to fit one of the opinions. If it contradicts a particular opinion, then there is already a safek whether it is the chilazon. That is obvious. I merely went through every point where it does not fit one of the opinions.]

C. Regarding what he writes in section 18, that according to Rav Yitzchak Isaac Halevi Herzog there was a mistaken version in the words of Rabbi Binyamin of Tudela:

I also wrote this in a letter that I sent to the honorable editorial board, which was printed at the end of that issue.

D. He writes there:

“Rabbi Herzog was already surprised to discover that the color produced from it is created artificially through chemicals that are added to it.”

This is astonishing. I myself quoted this, and I also quoted what Rabbi Herzog subsequently wrote:

“It therefore becomes clear that the aforementioned scientific experts, although they expressed their negative conclusion with complete confidence and certainty, were not speaking from actual experimentation but merely from conjecture, and direct observation contradicts them. This is an interesting phenomenon! From this, the intelligent reader can draw conclusions regarding many similar matters.”

I wrote that the proponents of Tekhelet ignore this and quote only Rabbi Herzog’s earlier words. It is therefore surprising that Rabbi Tavger once again repeats the very same argument — and the very same omission. Rabbi Herzog’s words at the end of the previous paragraph are quite appropriate here as well.
