כי היכי דליציל ציבעיה. קשה לר”י דמ”מ על נטילת הדם ליחייב משום נטילת נשמה ונראה כלשון אחר שפי’ בקונט’ בריש שמונה שרצים )לקמן קז.( דחובל בהן חייב משום דהוי תולדה דשוחט וחייב משום נטילת נשמה ונטילת הדם היינו נטילת נשמה כדכתיב כי הדם הוא הנפש ולכך ח’ שרצים שיש להם עור חייב בנצרר הדם אף על פי שלא יצא דכיון שנצרר סופו לצאת אלא שעתה העור מעכבו ושאר שרצים שאין להם עור אינו חייב עד שיצא מהם דם אבל בנצרר הדם ולא יצא לא מיחייב דכיון שלא יצא סופו לחזור דאם היה סופו לצאת היה יוצא מיד שאין העור מעכבו והשיב לו ר”ת דדם חלזון הראוי לצביעה מיפקד פקיד ולא מיחייב על אותו הדם משום נטילת נשמה ועל דם אחר היוצא עמו נמי לא מיחייב דלא ניחא ליה כי היכי דליציל ציבעיה אבל אין לפרש דנטילת נשמה היינו שמחליש אותו דבר שחובל בו דגבי דם בתולים מה צריך לחלישות האשה וגבי מילה מה צריך לחלישות התינוק אלא לנטילת הדם קרי נטילת נשמה כדפי’.

English Translation

Tosafos, Maseches Shabbos 75a:

“Ki heichi delitzil tzi’va’ei” (so that its dye should be preserved).

R”I asks: Nevertheless, one should be liable for extracting the blood due to netilas neshama (taking a life).

It seems that another explanation, as Rashi explains at the beginning of Shmona Sheratzim (107a), is that wounding them (chovel) is considered a toldah of shochet and is liable due to netilas neshama. Netilas hadam (taking blood) is netilas neshama, as it is written: “For the blood is the soul” (Devarim 12:23).

Therefore, for the eight sheratzim that have skin, one is liable even if the blood congealed and did not exit, since once it congeals, it is bound to come out, only that the skin currently holds it back. But for other sheratzim that do not have skin, one is not liable unless the blood actually exits. If the blood congeals but does not come out, one is not liable, since if it was meant to come out, it would have exited immediately, as there is no skin holding it back.

Rabeinu Tam responds that the blood of the chilazon, which is suitable for dyeing, is considered mipakad pakid (stored within rather than part of the body), and one is not liable for netilas neshama for that blood. As for the other blood that comes out with it, one is also not liable, since he does not desire its extraction—rather, he wants to preserve the dye.

However, one should not explain netilas neshama as merely weakening the thing being wounded, because regarding dam besulim (the blood of virginity), why would there be a need for the woman to become weakened? And regarding bris milah, why would there be a need for the infant to become weakened? Rather, netilas hadam is referred to as netilas neshama, as explained above.
